Acceptance of Terms

By accessing or using PutForm ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

If you are using PutForm on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you as an individual and the organization.

Eligibility

To use PutForm, you must:

• Be at least 13 years old (or 16 in jurisdictions where that is the minimum age).
• Have the legal capacity to enter into a binding agreement.
• Not be prohibited from using the Service under the laws of your jurisdiction.
• Not have been previously suspended or removed from the Service.

If you are under the age of majority in your jurisdiction, you may only use PutForm with the involvement and consent of a parent or legal guardian.

Accounts & Security

To access most features of the Service, you must create an account. When you do, you agree to:

• Provide accurate, current, and complete information during registration.
• Keep your password confidential and not share it with anyone else.
• Notify us immediately if you suspect unauthorized access to your account.
• Take responsibility for all activity that occurs under your account.

We use cookie-based sessions to authenticate users. You are responsible for ensuring that your device and browser are secure. We are not liable for losses caused by unauthorized use of your account where you have failed to keep your credentials secure.

Acceptable Use

You agree not to use PutForm to:

• Collect, store, or process data in violation of any applicable law (including GDPR, CCPA, or similar regulations).
• Create forms that harvest passwords, payment card numbers, or sensitive personal data without proper safeguards.
• Send spam, phishing messages, or misleading content through forms or submission endpoints.
• Distribute malware, viruses, or any code designed to harm systems or users.
• Attempt to gain unauthorized access to other accounts, servers, or networks.
• Reverse engineer, scrape, or overload the Service (including the API) beyond reasonable use.
• Impersonate another person or organization, or misrepresent your affiliation.
• Publish content that is hateful, defamatory, obscene, or violates anyone's rights.

We reserve the right to remove any content or suspend any account that violates these rules, with or without notice.

Your Content

You retain full ownership of the forms you create and the responses you collect ("Your Content"). We do not claim any ownership over Your Content.

By using PutForm, you grant us a limited, non-exclusive, worldwide license to host, store, process, and display Your Content solely for the purpose of operating and improving the Service. This license ends when you delete Your Content or your account, except where we are legally required to retain it.

Your responsibilities

• You are solely responsible for the lawfulness and accuracy of Your Content.
• You must have the necessary rights and consents to collect any data you gather through forms.
• You must provide appropriate privacy notices to your form respondents where required by law.
• You must not upload content that infringes third-party intellectual property rights.

Intellectual Property

The PutForm platform — including its source code, design, logos, trademarks, and documentation — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer or attempt to extract the source code, unless we have given you written permission or the law expressly permits it.

Nothing in these Terms grants you the right to use the PutForm name, logo, or branding without our prior written consent.

API & Integrations

PutForm provides public and authenticated REST endpoints for integrating the platform into your own products. When using our API, you agree to:

• Keep any API credentials and session cookies secure.
• Respect rate limits and avoid abusive request patterns.
• Not use the API to build a competing form-builder product.
• Comply with all applicable data protection laws when handling data received via the API.

We may modify, deprecate, or restrict API endpoints at any time. Where possible, we will provide advance notice of breaking changes.

Plans & Payments

PutForm offers free and paid plans. If you subscribe to a paid plan:

• Fees are billed in advance on a recurring basis (monthly or annually).
• All fees are non-refundable except where required by law.
• You authorize us to charge your chosen payment method on each renewal date.
• You are responsible for any taxes applicable to your subscription.

You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. Access to paid features continues until that date, but no further charges will be made.

Suspension & Termination

You may delete your account at any time. Once deleted, your forms and responses will be removed within 30 days, subject to any legal retention requirements.

We may suspend or terminate your access to PutForm if:

• You violate these Terms of Service.
• We are required to do so by law.
• Your use of the Service poses a security or legal risk to us or other users.
• Your account has been inactive for an extended period (we will provide notice first).

Upon termination, your right to use the Service ends immediately. Sections relating to intellectual property, liability, and governing law survive termination.

Disclaimers

PutForm is provided "as is" and "as available", without warranties of any kind, whether express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. While we work to keep uptime high, occasional downtime or bugs may occur.

Limitation of Liability

To the maximum extent permitted by law, PutForm and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the greater of: (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred US dollars (US $100).

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on the platform before the changes take effect.

Your continued use of PutForm after the changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.
